This year’s Institute addresses the practical implications of real estate transactions elder law attorneys face on a daily basis. Experts from the land court, the real estate bar and elder law share their experience with the alphabet of issues identified on the NAELA listserv as the most pressing to you.

All elder law attorneys are faced with navigating thorny issues related to the use of special powers of appointments in deeds, as well as the consequences of releasing a life estate interest. The checklist of issues varies from how to ”disjoint” joint interests to the practical implications of a petition to partition. The impact of DRA – 05 is addressed in the context of the myriad of concerns that arise in utilizing new planning strategies that now include the use of promissory notes and reverse mortgages. The use of life estates and nominee trusts as well as all other forms of real estate transfers including the homestead provisions will be presented so you will be better equipped to handle these issues. The Institute faculty is most sensitive to insuring that the all real estate transfer issues that are stumbling points for practitioners or raise anxiety levels are discussed, including the tax implications of various transactions.

The unique aspect of this year’s Institute is the emphasis on real estate transactions, including potential title and conveyancying problems that go unnoticed by busy elder law practitioners. The tax, Medicaid and title consequences arising out of various conveyances. Tax discussion includes stepped up basis, capital gain tax, and § 121 eligibility. Discussion of issues to watch for with respect to conveyance of primary residence v. vacation property v. residential rental property v. commercial property. Refunds:  

Written requests for cancellations received via fax or email 24 hours prior to the program will be granted a refund, minus a $15 charge. If you cannot attend, you can send a substitute, otherwise you will receive the written course materials.
