The 36th Annual Labor Law Conference addresses topics of critical importance to practitioners, analyzes developments, and frames forthcoming issues. Solicitor of Labor Gregory F. Jacob, the chief legal officer and third-ranking official of the U.S. Department of Labor, delivers a keynote address on recent developments in laws affecting the American workforce. The NLRB’s Deputy Associate General Counsel for the Division of Advice, Ellen A. Farrell, delivers a keynote address on the General Counsel’s recent prosecutorial decisions on concerted protected activity and bargaining issues. Written materials to supplement presentations will be provided.

The NLRB panel focuses on Register-Guard, one of the last decisions of the Bush Board, in which the Board for the first time addressed the right of employees to use an employer’s e-mail system for union solicitation and modified Board law on discriminatory enforcement of rules. Counsel in this case, to be argued on appeals from both sides in the D.C. Circuit this fall, discuss how it and other recent cases affect the Board’s analysis of non-discriminatory enforcement of solicitation, distribution, and other protected conduct.

The DOL panel provides insight into the Department’s enforcement priorities for 2008-09. Moderated by Professor Marc Greenbaum of Suffolk University Law School, it features the top regional officials of the Occupational Safety and Health Administration (OSHA), the Wage & Hour Division (WHD), and the Employee Benefits Security Administration (EBSA), which oversees ERISA.

We conclude with a networking and cocktail reception. Don’t miss this opportunity to meet with colleagues, program faculty, and leaders of the labor and employment bar.
