Significant challenges confront both practitioners and the court in implementing and applying the sweeping changes encompassed by the guardianship and conservatorship portion (Article V) of the Massachusetts Uniform Probate Code that took effect on July 1, 2009. This annual conference explores both the substantive and procedural issues that have arisen and their implications. It provides an interactive forum for the discussion of the issues that both practitioners and the courts have encountered since the new law was enacted. You will have the opportunity to be on the cutting edge with regard to the analysis of how to practice effectively under the new law. You will learn how judges, judicial case managers and leading attorneys in the area are interpreting and applying the provisions of the MUPC.
Who Should Attend:
This program is designed for professionals who are involved in guardianship and conservatorship practice, including attorneys, professional guardians, family guardians, geriatric care managers, social workers, psychologists, psychiatrists and specialized facility managers.
Attend and Learn:
- How to identify decisions that an incapacitated person “can” and “cannot” make
- How to craft meaningful limited guardianship and conservatorship decrees
- Discussion of practical tips for completing the new MUPC forms
- How to effectively seek authority for admission into a “nursing facility”, and a discussion of what is considered to be a “nursing facility” under the new code
- What is the role of appointed counsel under the MUPC and how will this affect practice
- What are the implications of the new procedures on the privacy rights of incapacitated persons
- A discussion of substituted judgment-What is “extraordinary medical treatment”
