Goodridge v. Dept. of Public Health, the landmark 2004 decision, enabled same-sex couples in Massachusetts to marry. However, the federal Defense of Marriage Act prohibits the United States government from recognizing the marriages of same-sex couples regardless of the recognition afforded by the states. The result is that post-Goodridge, many of the federal benefits and protections afforded to heterosexual married couples are not equally applied to same-sex couples legally married. Same-sex couples are unable to benefit from many tax and estate advantages, do not enjoy the same rights to surviving children, and are denied the same health care benefits.

Thorny legal issues relating to the intersection of state and federal laws are not the only complexities in this field as implementation may pose particular cultural challenges. Many gay, lesbian, bisexual, and transgendered litigants feel that they are being treated differently than heterosexuals in the Court by court personnel, their lawyers, opposing counsel, and others in the courtroom. Knowing how to handle these cutting-edge issues effectively, and with confidence, can be challenging.

This program will give you the tools and know-how to avoid the legal pitfalls unique to same-sex marriage, divorce and parenting. New family law practitioners will obtain an informative overview and experienced practitioners will benefit from detailed updates on this ever-changing area of the law.
