ABOUT THE CONFERENCE

Elder clients consult you for advice about how to plan for long term care. Those with foresight seek advice early enough to incorporate the Medicaid 5-year look back into their planning. Those less fortunate seek advice at the last minute—when an elder needs long term care imminently or is already receiving it. Some elders are single—widowed, divorced, never married—others have a spouse. Although there are as many variations as there are clients, one way to view the various planning scenarios is to view elder planning as either Advanced Long Range or Last Minute Crisis and within each of those segments, as planning for couples or single elders. This annual Institute looks at planning strategies within those four groups—Advanced Long Range Planning for Couples and Singles and Last Minute Crisis Planning for Couples and Singles.

The panelists walk you through various scenarios as they describe the Medicaid planning process from beginning to end going into depth about the best planning strategies and practices, when to recommend them, and how they are accomplished. When is it appropriate to use an Irrevocable Trust and what effect has the Doherty decision had on the use and format of such trusts? When is it appropriate to recommend a Pooled Trust for a Massachusetts elder and what is the status of transfers to such trusts by those who are over 65? Can an elder pay a relative to provide care to the elder and what are the risks and benefits of various techniques? Can elder couples really save all of their assets for the healthy spouse when one of them needs nursing home care? Is there any way to get long term care at home rather than go to a nursing home?
