ABOUT THE CONFERENCE

In a first of its kind all day conference, BSEA Hearing officers, and experienced special education attorneys who represent both parents and school districts will come together to act out various hot button issues in special education law, culminating in a partial BSEA Hearing.

Beginning with a role play of a Team Meeting to determine special education eligibility, the morning will continue with a second role play of a manifestation determination meeting and a school discipline hearing. The afternoon will be devoted to a role play of an expedited Manifestation Determination Hearing highlighting expert testimony and cross-examination.

There will be time for discussion and questions after each role play and other topics will be touched upon including, settlement conferences, new bullying legislation, superintendent’s appeals and court challenges, an overview of the hearing process, and compensatory claims. This is a conference you won’t want to miss!

  • What goes on at an actual TEAM meeting, expulsion hearing and manifestation determination hearing before the BSEA and how to prepare for each

  • How school discipline and special education law intersect and how to handle these complex cases

  • How to incorporate the new anti-bullying legislation into your advocacy

  • How to conduct examinations of experts at a BSEA Hearing

10:30 MANIFESTATION MEETING AND A DISCIPLINE HEARING AT SCHOOL
Janie’s court-appointed criminal defense attorney refers Janie and her mother to a public interest law firm. A Request for Hearing is filed, challenging the failure to find a manifestation, the failure to find eligible for special education in December 2009 and the failure to identify since fifth grade.

The Settlement Conference is not successful in resolving all of the issues. The Ramone Public Schools files a Motion to Dismiss any claim for relief for any action prior to February 1, 2008 based upon the Statute of Limitations
