ABOUT THE PROGRAM

Just about any attorney living along the coast will sooner or later run into a case dealing with admiralty or maritime issues for commercial or pleasure boats. Although these cases involve a specialized body of knowledge and practice, general practitioners benefit from an understanding of the law and procedure as these cases can involve negligence, wrongful death, property damage and/or environmental issues. Admiralty Law: Maritime Mishaps and Mistakes gives you the opportunity to learn from the experts about their experiences and how to best respond when such a case comes in. The program is based on a hypothetical case that is a combination of several cases in which the faculty members have been involved. The case is used as a starting point to identify areas of substantive and procedural law that may apply in admiralty law cases. You will learn about the substantive law and see how it is analyzed and applied to a particular set of facts. The next time you have a case that involves admiralty law, you will know what to do.

WHO SHOULD ATTEND

The seminar is designed for attorneys in a general defense or plaintiff’s practice who have the occasional admiralty case come into the office. The claims could involve personal injury, wrongful death, pollution damages, property damages, and claims against a marina. The seminar would also benefit marine claims professionals, marina operators and maritime risk management professionals.

  • You will get an overview and update of specific areas of admiralty and maritime law that are important for the general practitioner to be aware of.

  • You will learn how to apply the statutes and case law to a set of facts and analyze the new case that comes into the office so that you can advise the client on the law that will apply and the likely available forums in which the matter may be heard.

  • Learn practice tips from the panel in terms of investigating claims or potential claims, timing of litigation, compliance with limitation periods, and how to defend against the same.

    If for some reason you are not able to attend, you may send a substitute or call no later than the business day before to receive a refund less a $15.00 cancellation fee. Otherwise, you will receive the course materials.
