The process for administering estates will dramatically change on January2, 2012. The new Massachusetts Uniform Probate Code introduces new options for probating estates. It provides speedy, flexible, efficient and private administrative procedures for the majority of estates which are routine and uncontested. Prior judicial procedures are largely retained as an option for those seeking or needing assurance of a formal decree before proceeding to settle estates. Additional procedures are available to provide protection to fiduciaries and interested parties. This new flexible system is designed to provide as little or as much in procedural safeguards as are appropriate in varying circumstances. These optional procedures are available for both opening and closing of estates.
This presentation will outline the new procedures and options from opening an estate through administration and closing, as well as for contested estates. New drafting considerations for estate planners will be highlighted throughout.
