ABOUT THE CONFERENCE
Qualification as “statutory subject matter” has been an increasingly common topic of recent caselaw, including a surprising number of cases heard by the U.S. Supreme Court. Fundamental questions are now being raised in several areas, including medical diagnostic testing, software, business methods, and even the patentability of isolated genetic material. The conference will discuss recent cases opining on statutory subject matter and guidelines planned by the U.S. Patent and Trademark Office to assist Examiners in determining whether a claimed invention qualifies as statutory subject matter.

The America Invents Act, the most significant legislative reform in Patent Law since 1952, was enacted in September 2011 after a long awaited delay in Congress and the Senate. The US Patent and Trademark Office is actively soliciting input as it formulates rules for examination in view of the new Act. Maintaining, planning and enforcing patent rights will likely change in light of the new law and rules. Controversial issues raised by the Act will be discussed in detail.
