ABOUT THE CONFERENCE Between 80-90% of all criminal cases are resolved through plea negotiations. In recent US Supreme Court cases, the court expanded judges’ supervision of the process and ruled that defendants have a constitutional right to effective assistance of counsel in plea negotiations. Do you know the most effective way to represent your client or the Commonwealth?
Negotiating a Disposition in a Criminal Case provides insight from judges and experienced attorneys on the appropriate ways to handle plea negotiations and the potential dangers of the process. You will hear about practical ways to approach judges and prosecutors and what you can do to prepare, if you are defense counsel. Prosecutors will also benefit from presentations about the role of an assistant district attorney in plea bargaining and formulating sentencing recommendations. Judges will gain insight into the accepted role of the judiciary in assisting parties reach a resolution before trial. You will learn about recent decisions and how to apply the results to your cases. In addition, you will benefit from analysis of the new proposed rules of criminal procedure in Massachusetts on plea agreements.
