International Intellectual Property Licensing

This seminar will address the legal issues that arise in the international licensing of patents, copyrights, trademarks, and trade secrets (or know-how). We will begin with brief overviews of intellectual property and of licensing terms and strategies, but the main emphasis will be on the limits to intellectual property owners' control of their property. Most of the course will focus on antitrust/competition law and on the limits it imposes on licensing arrangements. Included in this portion of the course will be an examination of the U.S. cases and guidelines, the EC block exemptions, and the Japanese guidelines. In addition, we will discuss the ways in which owners can be forced to provide access to their intellectual property, such as through the imposition of implied or compulsory licenses.
