Mediation Advocacy Seminar

3 credits day; 3 credits evening.

In modern America legal disputes are rarely decided by judges or juries. Rather, the vast majority settle through negotiation or mediation. This seminar focuses on how legal cases are settled, from the perspective of the advocate. Students will study the theory of negotiation and, through roleplaying, will develop their ability to bargain for clients. The seminar will also examine mediation, the most popular form of third-party dispute resolution, again with a focus on the role of the lawyer and with opportunities for role-playing. Grades will be based on class participation and short papers involving analysis of course exercises and materials. Enrollment is limited to 18 students.

Prerequisite: Students who have taken another negotiation or mediation course or Prof. Golann's ADR survey course may not enroll in this seminar.   Enrollment is limited: 18   Elective Course   Meets Health/Biomedical Concentration Requirements   Final Paper Required
