Public Health Law

This course will introduce the student to public health concepts and legal issues. The course will explore the legal basis for, and exercise of, public health authority and the limits on that authority. Issues discussed will include: surveillance/research and confidentiality; communicable disease control; emergency public health authority/bioterrorism (vaccination/isolation/quarantine); torts/public health litigation and environmental health. The text will be supplemented by cases, and supplementary legal materials including case studies and regulatory resources from the Massachusetts Department of Public Health.
Grading will be non-anonymous and by alphabetic grade method. Evaluation will be based on class participation, short writing assignments, and a final presentation.
Prerequisite: Constitutional Law
