Health Law Seminar: Conflicts of Interest in Medicine

This course examines physicians' conflicts of interest in medical practice, the means the medical profession has used to address them, and the role of legislatures, regulatory agencies, and courts in coping with these problems. We will examine how physican roles, payment, and financial ties with 3rd parties can compromise the physician's duty to act in the interest of their patients. The course probes problems related to physician entrepreneurialism, and also the relations between physicians and pharmaceutical and insurance companies, and other physician-owned and investor-owned for-profit firms. The focus is on contemporary practice in the United States but we will also review how conflicts of interest have evolved, and how conflicts of interest differ in other countries due to institutions, laws, and financing arrangements. Students will write a paper on a topic of their choice. Grades will be based on a paper and class participation. Taking this seminar does not preclude taking another health care seminar on a different topic.
