Future of Civil Rights and Civil Liberties in the Age of Terrorism
Hon. Geraldine Hines
2 credits day; 2 credits evening.

Though distinct legal concepts, civil rights and civil liberties owe their genesis to the Bill of Rights in the Constitution. In the aftermath of the September 11 terrorist attack, the constitutional rights to freedom of religious and political expression, equal protection and due process of law have been in tension with the exercise of federal executive and legislative power in the “war on terror.” The FISA Amendments Act of 2008, the USA Patriot Act and the Military Commissions Act of 2006 have dramatically expanded federal power and resulted in profound changes to the civil liberties/civil rights landscape for both citizens and non-citizens. This course will examine these statutes and the most important post-September 11 cases, including Boumediene v. Bush, 553 U.S. 723 (2008), Hamdi v. Rumsfeld, 542 U.S. 507 (2004), to allow students to develop an understanding of how the court balances the competing interests in national security with the individual’s civil rights and civil liberties.
