Bankruptcy Material

                                                                                                     Adv. Menu - Main Menu

Info:- An adverse party is a debtor or creditor who has brought a suit during a bankruptcy proceeding.

Cite bankruptcy cases as follows:-

(1) If both an adverse and nonadverse party appear at the beginning of an opinion, then its the adverse party first followed by the nonadverse party. Add the nonadverse party in parenthetical (which will be preceded by the procedural phrase in re. Italicize the in re).

For example:

Kwarendo v. McNaghtern (In re McNaghtern), 34 B.R. 23 (Bankr. D. Mass. 1990)

Note: Indicate the bankruptcy court in the parenthetical as the B.R. reporter abbreviation by itself does not tell the court/jurisdiction.

(2) If only one party is provided in the opinion, then insert the party name preceded by in re.

For example:

In re McNaghtern, 34 B.R. 23 (Bankr. D. Mass. 1990)
